どんなものにでも肖像権はあるのですが、公共物であったり(都庁とか富士山とか)、公共の場所から普通に見えるもの、については、肖像権が認定されません。道を歩いていて写真を撮ったら、「うちが写ってるじゃないか、肖像権の侵害だ」という主張は、成り立ちません。公共の場所から普通に見えるものは、肖像権の対象とならないのです
